A condemnation action occurs when a government entity seizes private property for public use and compensates the landowner.  The government power to do this is called eminent domain.  The property owners are entitled to compensation for the portion of property taken during condemnation.  The property owners do not have to accept the compensation offer or if they do not want to sell.  At this time, the government entity will file a Complaint with the Court for eminent domain and the landowners must file an Answer to the Complaint if they disagree with the taking of the land or the monetary offer by the government entity.  A Hearing date will be scheduled for the government entity to show the property is being taken for public use and that the monetary amount offered is reasonable.  The landowners will be given the opportunity to respond to the claims made by the government entity.

Government entities may also condemn property they deem ‘blighted’.  The criteria for such include:

                        -  deteriorating structures
                        -  inadequate street layout
                        -  faulty lot layout
                        -  obsolete platting
                        -  excessive vacant land
